- These Terms of Use apply in whole to all individuals and entities who visit the Safe Capital website (“Site”) (https://www.safecapital.co.uk/). Luris Systems Ltd, trading as Safe Capital, has a registered office address of 41 Bridgeman Terrace, Wigan, England, WN1 1TT with company number 15361556 and email address of help@safecapital.co.uk.
- By visiting/using or interacting with the Site, you agree to the applicability of these Terms of Use to the relationship between yourself and Safe Capital. For this reason, it is important that you take your time to read this document carefully.
- Please note that these Terms of Use are governed by, and construed in accordance with, the law of England and Wales. If you are accessing the Site from outside of the United Kingdom, as a user of the Site you are solely responsible for complying with all local laws and regulations.

Description
- The Safe Capital Site outlines the functionality of the products and services offered alongside providing educational information and resources, including webinars and blog posts, to users of the Site.
- Safe Capital provides a secure service that allows you as a customer to make payments and share verified bank account information to one of our clients (e.g., your law firm).
- The service consists of:
- Payment Initiation Services (“PIS”) where you can initiate payments directly and securely from your financial services provider using open banking, and;
- Account Details Services (“ADS”) where you can share bank account information (limited to customer name, account number and sort code) directly and securely from your financial services provider using open banking.
- Residual Balance Reduction Services, where you can automate the process of contacting customers to obtain bank details and return residual balances.
- Any payments are requested from you directly by Safe Capital’s client and go directly to Safe Capital’s client. Any bank account information you choose to share is provided directly to Safe Capital’s client.
- Safe Capital uses services provided by Moneyhub Financial Technology Limited and GoCardless Ltd that allow you to send payments to Safe Capital’s client and provide your bank account information to them securely. More information on this relationship can be found in Safe Capital’s Privacy Policy linked below in Section 9.

Acceptable Use
- The Site must only be used in compliance with these Terms of Use. You must not use the Site in a manner that is unlawful or fraudulent.
- You must not knowingly cause harm to the Site by uploading, sending or in any way transmitting data that contains any form of virus or malware or any other code designed to adversely affect computer, hardware, software, or data of any kind.
- You must not knowingly cause any harm to any other user of the Site.
- You must not post anything that could be deemed offensive and/or illegal.
- You must not ask for legal or financial advice from any of the users directly through the Site.
- You must not provide financial and legal advice through the Site.
- You must make sure anything that you do post does not infringe anyone else’s intellectual property rights.
- You must not post any information or image that they know or should know is either false, inaccurate or misleading or can otherwise jeopardize the integrity of the Site.
- Safe Capital reserves the right to remove any content it deems unacceptable at its sole discretion.
- Safe Capital reserves the right to suspend or restrict access to the Site, to areas of the Site and/or to functionality upon the Site. Safe Capital may, for example, suspend access to the Site during server maintenance or when updating the Site. You must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on the Site.

- Links to third party sites may be included or embedded into the Site. Unless expressly stated, these sites are not under the control of Safe Capital. Consequently, Safe Capital neither assumes nor accepts any responsibility or liability for the content displayed on any third-party sites.
- The inclusion of a link to another site is for information purposes only and does not imply any endorsement of the sites themselves or of those in control of them.

Intellectual Property
- All content on the Site, including copyright or trademark material or other intellectual property, belongs to Safe Capital. Such content is protected by Intellectual Property laws and regulations and may not be copied, reproduced or used in any way without express permission from Safe Capital.
- Intellectual property on the Site may be reshared or used by others with the express consent of Safe Capital and must contain appropriate reference to the Site as its source.

Indemnity
- As a user of the Site, you shall defend, indemnify and hold harmless Safe Capital against claims, actions or proceedings for losses, damages and costs, including court costs and reasonable legal fees, arising out of or in connection with your use of the Site.

- Safe Capital does its best to ensure the safety, security and accessibility of the Site. However, Safe Capital cannot be held liable for any damages directly or indirectly resulting from the use of the Site.

- Safe Capital accepts no liability for any harm for any user’s reliance on information posted or other harm that might arise.

- Any disputes concerning these Terms and Conditions, the relationship between individuals, entities and Safe Capital, or any matters arising therefrom or associated therewith (whether contractual or otherwise), shall be subject to the jurisdiction of the courts of England and Wales.

- Any complaints about information or interactions on the Site can be directed to help@safecapital.co.uk. It is at the sole discretion of Safe Capital as to whether the information will be removed or amended.
